These General Terms and Conditions regulate the acquisition of the products offered on the website carmensimonart.com, owned by Carmen Simon Dalmau (hereinafter, CSD).

The acquisition of any product implies full and unconditional acceptance of all the General Terms and Conditions outlined, without prejudice to the acceptance of any Specific Terms and Conditions that may apply when acquiring certain products.

These General Terms and Conditions may be modified without prior notice; therefore, it is advisable to carefully read their content before proceeding with the acquisition of any of the products offered.

All notifications and communications between users and CSD will be considered effective, for all purposes, when carried out through the means detailed above.

The products offered on carmensimonart.com, along with their main characteristics and their price, appear on the screen.

CSD reserves the right to decide, at any time, the products and/or services offered to clients. Thus, CSD may, at any time, add new products and/or services to those currently offered. Similarly, CSD reserves the right to withdraw or cease offering, at any time and without prior notice, any of the products offered.

Once inside carmensimonart.com, and to access the purchase of different products, the User must follow all the instructions indicated during the purchase process, which entails reading and accepting all the general and specific terms and conditions set on carmensimonart.com.

  1. AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

CSD aims to guarantee the availability of all the products advertised through carmensimonart.com. However, if any requested product is unavailable or out of stock, the client will be informed via the email address used during their purchase as soon as possible.

If the product is unavailable and the consumer has been informed, CSD may supply a product with similar characteristics at no additional cost. In such a case, the consumer may accept or reject it, exercising their right of withdrawal and contract termination.

In the event of unavailability of the entirety or part of the order, and the client’s rejection of substitute products, the amount previously paid will be refunded using the same payment method used during the purchase.

If CSD delays unjustifiably in refunding the amounts paid, the consumer may claim twice the owed amount.

  1. PURCHASE PROCESS AND/OR CONTRACTING

To make any purchase on carmensimonart.com, the client must be of legal age.

The steps to follow to make a purchase are:

  • Select the products you wish to add to the cart.
  • When finished, access your cart to review your purchase.
  • Add or remove products at your convenience.
  • Once completed, proceed to the payment and, if applicable, shipping process.

The client can access their previous purchases by logging into their user account.

Additionally, it is recommended that the client print and/or save a durable copy of the terms of sale when placing their order, as well as the receipt confirmation sent by CSD via email.

BILLING

For this purpose, the client consents to receive the invoice electronically. The client will receive it in their email account once the purchase is confirmed. The client may, at any time, revoke this consent by sending an email to customer service to receive the invoice in paper format.

  1. DELIVERY

PRODUCTS

The order will be delivered to the address designated by the client at the time of contracting, according to the chosen method.

Above all, review all fields with shipping information before making the payment. If you detect an error after payment, send an email to hola@carmensimonart.com before your order is shipped, and we will handle the correction.

The delivery address does not have to match the billing address or the one listed in the registry; orders can be sent to different addresses.

If, upon receiving your order, you detect any anomaly, notify us as soon as possible at hola@carmensimonart.com so we can resolve the issue.

SHIPPING METHODS AND DELIVERY TIMES

Shipping is carried out through recognized transport agencies or by mail, depending on the product, size, weight, and quantity:

  • The delivery time is, from the moment the order confirmation email is received, approximately 3 to 5 business days.
  • Occasionally, depending on the area or workload peaks, orders may take up to 15 days, but you will always have information on the status and location of your order.

The delivery scope includes the following areas:

Shipments to the Province of Girona:

  • Free shipping costs for purchases over €100.
  • For orders under €100, the shipping cost is €4.90.

Shipments to the Rest of Catalonia:

  • Free shipping costs for purchases over €100.
  • For orders under €100, the shipping cost is €4.90.

Shipments to Spain and Portugal (Mainland):

  • Free shipping costs for purchases over €100.
  • For orders under €100, the shipping cost is €4.90.

Shipments to the Balearic Islands, Canary Islands, Ceuta, Melilla, or the EU Community:

  • Free shipping costs for purchases over €100.
  • For orders under €100, the shipping cost is €4.90.

  1. PRICES, FEES, AND TAXES

The prices of the products on carmensimonart.com will be expressed in euros unless otherwise stated and are guaranteed during their validity period, except for typographical errors, regardless of the destination of the order.

PRODUCTS

The final prices of all products (and, where applicable, the final prices per unit of measurement, when mandatory), along with their main characteristics, offers, discounts, etc., are reflected in each of the items listed in the catalog of the carmensimonart.com store.

The products include VAT, calculated in each case at the current rate, and are expressed in euros.

Shipping fees: these can be consulted in section number 6, “Product Delivery.”

The prices of the products may vary at any time. In this case, the price to be applied will be the one in effect on the date the order is placed. In any case, the final cost will be communicated to the client during the electronic purchase process before the client formalizes their acceptance.

  1. RETURN AND WITHDRAWAL POLICY

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract within a maximum period of 14 calendar days without needing to indicate the reason and without incurring any cost, except for those stipulated in articles 107.2 and 108 of RD1/2007, dated November 16, which approves the revised text of the General Law for the Defense of Consumers and Users.

This right of withdrawal does not apply, among others, to:

  • The supply of sealed goods that are not suitable for return and have been unsealed and/or damaged after delivery.

PRODUCTS

The client will have a maximum period of 14 calendar days from the day of receipt of the good or requested product to inform CSD via the customer service email hola@carmensimonart.com of their desire to withdraw from the contract.

The withdrawal implies that CSD will refund the amount already paid by the client within a maximum period of 14 calendar days, following the same method chosen by the client for their payment (provided the acquired product is not within the exceptions indicated above).

During this period, the consumer will communicate to the seller their decision to withdraw from the contract by completing the form found at the end of this document and sending it to the email address hola@carmensimonart.com.

CSD will inform the consumer on durable media of an acknowledgment of receipt of this withdrawal.

To proceed with the return of a product, it is essential that it is in perfect condition and in its original packaging.

Once we receive your request, we will contact you to provide the details for the return.

The client will bear the costs of returning the goods.

  1. RETURN POLICY

If a product arrives in poor condition, unsealed, or damaged during transport, it can be returned within 7 days of receiving the order. A return can be made for an individual item or the entire order by contacting CSD via email at hola@carmensimonart.com, explaining the reason for the return.

If the return is unrelated to a defect or error in the product, we will accept returns within the first 14 calendar days from the date of receipt, provided that the conditions regulated by Law 3/2014 of March 27, Article 71 on trade regulation, are met. The product must be returned in the same condition as it was received and must not have been unsealed. It must be returned as it was sent.

The refund for the value of the goods will be made within a maximum of 15 days of receipt, once the condition of the returned item has been verified. The client will bear the shipping costs, which will be the same as the original shipping cost.

  1. CUSTOMER SERVICE AND CLAIMS

To file any complaint or claim with CSD, the client must contact the customer service department via the email address hola@carmensimonart.com.

According to the EU online consumer dispute resolution regulation and in compliance with Article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform, available at the following link: http://ec.europa.eu/consumers/odr/.

Right of Withdrawal

You have the right to withdraw from this contract within 14 calendar days without the need for justification unless the product falls under the exceptions to the right of withdrawal as indicated in section 9 of these general terms and conditions.

The withdrawal period will expire 14 calendar days from the day you or a third party indicated by you, other than the carrier, acquires physical possession of the goods.

Procedure to exercise your right of withdrawal:

To exercise the right of withdrawal, you must notify us using the means we provide, of your decision to withdraw from the contract through an unequivocal statement (e.g., a letter sent by postal mail or email). You may use the model withdrawal form included below, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication regarding the exercise of this right to be sent before the corresponding deadline expires.

Consequences of Withdrawal:

In the event of withdrawal, we will refund all payments received from you, including delivery expenses (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us) without undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from this contract. We will proceed with the reimbursement using the same payment method you used for the initial transaction unless you have expressly agreed otherwise; in any case, no fees will be incurred as a result of the reimbursement.

You must return or deliver the goods directly to CSD without undue delay and, in any case, no later than 14 calendar days from the date you notify us of your decision to withdraw from the contract. The deadline is met if you return the goods before the 14-day period has expired. We may withhold the reimbursement until we have received the goods or until you have provided proof of returning them, whichever occurs first.

You will bear the direct cost of returning the goods.

You will only be responsible for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
